MEMBERSHIP TERMS AND CONDITIONS


Definitions


Application Form
– the membership application, direct debit instruction, the activity readiness questionnaire and the club rules.
Children – people under 17 years of age and accompanied by a member.
The club rules – the conditions set out in sections 1 to 12 below together with the application form, rules of membership and any other rules which may apply by law.
Physical activity readiness questionnaire (PARQ) – you must fill in the physical activity readiness questionnaire before using any facility of the club. certain medical conditions may mean you need a medical referral and a specific exercise programme before we can give you full membership.
Fees
We have several categories of fees.
Joining fee – a non refundable fee paid on joining Branston Golf & Country Club.
Monthly membership fees – the fees you must pay each month by direct debit for the month ahead for at least 6 months unless on ‘Corporate contract’, see below.
Annual membership fees – fees you pay for the year to come.
Corporate contract – membership paid each month by direct debit for at least 12 months.
Defaulting – If you stop paying the monthly fee, we will ask you to pay the remainder of your initial term
Other fees – for example beauty therapy, tanning, bar or restaurant, crèche and any other services. We can change the fees if we decide.
Guest fee – a charge for your guest to use the facilities.
Initial term – the period which ends six or twelve months after the date you join. You may not cancel your membership during the initial term unless you can give us a doctor’s medical certificate or a letter confirming redundancy from your employer. The cancellation will only apply when we receive a medical certificate or employer’s letter.
Minimum notice period – you must give Branston Golf & Country Club one calendar month’s notice after the end of the six or twelve month initial term period.  Branston Golf & Country Club will give you a cancellation reference. It is your responsibility to keep a record of the reference as proof you have cancelled your membership.
Members – people who we accept to become members and their children. If you are under 18, your parent or guardian must sign this.

Club rules of membership

  • A copy of the club rules is available at reception.
  • If we are going to temporarily change the club rules, we will display any amendments in reception. We will only make permanent changes after giving you at least one month’s notice. You may cancel your membership if these changes are unacceptable. You must give the minimum notice period.
  • When you sign the application form you are agreeing to pay the fees and keep to the club rules.

About your membership

  • We may end your membership without notice if you repeatedly or seriously break the club rules.
  • We will charge you £5 if your direct debit is rejected. If your direct debit is rejected on two or more occasions, we will cancel your membership and charge you the remainder of your initial term. If you want to reinstate your membership having defaulted, you will have to pay the direct debits which were rejected plus an administrative fee.
  • When you join you have 14 days to change your mind and receive a full refund.

Your membership card

  • You will receive a membership card. You must present your membership card at reception. If you forget your card, we may need to see proof of identity. If you have lost your card, we may charge you for a replacement at our discretion.
  • Your membership applies to you and you cannot loan or transfer it to another person.

Suspending your membership

  • You may suspend your membership for at least 3 but not more than 12 months. (We can only suspend your membership from the 1st of the month.) We will charge a retention fee during the suspension period. You may also suspend your membership if you have a six or a 12 month contract period. When we receive the suspension charge, we will extend your membership by the length of the suspension period.
  • We cannot suspend your membership retrospectively. In other words, you cannot ask us to suspend your membership for a period which has passed when you did not visit and use the facilities for any reason.
  • If you want to suspend your membership, you must notify Branston Golf & Country Club in writing giving at least one full calendar month’s notice.


Repairing or removing club facilities

  • To provide the highest standards of facilities we occasionally need to carry out repairs and refurbishment. We will not provide credit or refund subscription at these times.

If you cancel

  • If you want to cancel your membership, please notify Branston Golf & Country Club in writing. See Fees section above about the notice you must give.
  • If one person who has joint membership cancels or suspends, the other person’s membership will change over to the individual rate. If you cancel during the suspension period, we will charge you the monthly membership fee in line with the minimum notice period.


Guest

  • You may bring guests to the club. You must present an appropriate guest pass, if not we will charge you a guest fee.  Each guest must fill in the relevant forms and you must stay with your guest and make sure that they keep to the club rules. Passes may not be used for children under 17.
  • We can refuse your guest entry to the club for any reasons of health and safety or if your guest does not keep to the behaviour section of these rules (Behaviour section below)


Your children

  • Children must have an adult member with them to supervise them. You must make sure that your children only use the facilities allowed, which are clearly marked.
  • We provide crèche facilities for children aged 8 weeks to 5 years. You may use the crèche for up to 2 hours a day. Please check with the club for availability and specific crèche rules. You may not leave the club if you have children in the crèche. Only infant members may book the crèche. Infant guests may use the crèche if space permits on the day.


Behaviour

  • You must wear appropriate clothes and shoes in the club. In the interest of health and hygiene, you must shower before entering the pool, hot-tub, steam or sauna areas.
  • You and your guests must not:
    • abuse the equipment or facilities of the club (you will have to pay for any negligent or deliberate damage to club property);
    • behave in a violent or rude way or in a way which offends, distresses or annoys anyone else;
    • smoke in any part of the club;
    • bring alcoholic drinks, drugs or other mood-altering substances into the club;
    • use the facilities of the club while under the influence of alcohol, narcotics or other mood-altering substances or;
    • drink alcohol in any areas other than those we allow.
  • We can refuse admission or ask your guest to leave the club if we reasonably believe that you or they have broken any section of the rule above

  • The club’s Managing Director will make the final decision as to who can become a member.

Disclaimer

  • We will compensate you for any loss or damage you may suffer if we fail to carry out our obligations under this agreement or to a reasonable standard. This also applies if we break any duties placed on us by law (including if we cause death or personal injury to you by our negligence),unless that failure is due to:
    • your own fault (including paying attention to health and safety signs and staff instructions);
    • another person or company not connected with the services we provide under this agreement; or
    • events which neither our suppliers nor we could have expected even if we had taken all reasonable care.
  • We are not insured for any loss, damage or theft of your personal property, or that of your guests, on club premises.
  • You must fill in the physical activity readiness questionnaire (PARQ) before using the gym. Certain medical conditions may mean you need a medical referral and a specific exercise programme before we can give you full membership.


Other

  • We can:
    • change, withdraw or add to these rules (see section Club Rules of Membership if you are unhappy with any changes of these rules);
    • change operating hours of the club;
    • change certain facilities temporarily for decorating, cleaning, essential repairs or maintenance of equipment and special events;
    • refuse to book an appointment if you repeatedly cancel;
    • show new members and other individuals the facilities of the club and allow them to access on a trial basis; and use any photographs of members or guests for promotional purposes.
  • You can book for any class up to 7 days before the class you want to attend.
  • Branston Golf & Country Club provides lockers for use while in the club. We may remove any items you leave in the lockers overnight. We can inspect the contents of all lockers for security reasons.
  • We will not allow photography within the crèche, pool area, gym or studios unless we give permission beforehand.


GOLF DAY TERMS AND CONDITIONS


Deposit

Once a provisional booking has been made the booking will be held for 14 days. On receipt of a deposit of £5.00 per person and a signed booking form the booking will be confirmed.

 


Cancellation Policy

The following charges will apply on the cancellation of your booking:-

100% of the total booking value

 


Cancellation by Branston Golf and Country Club

In the unlikely event that we are forced to cancel your booking you will be refunded any payments in full.  After this, Branston will accept no further liability.  The only reason for Branston cancelling your event would be:-

  • Any part of the venue or course is closed or unavailable due to events beyond our control.
  • If you or we become insolvent, or in the case of an individual becomes subject to a bankruptcy petition
  • The booking or anyone associated with the booking might damage the reputation of the club

 


Change in numbers

Final numbers are required one week prior to your event date; this number will then be charged for regardless of last minute decreases in numbers. Should your numbers increase less than two weeks prior to the event date, every effort will be made to accommodate this change, however availability of tee times cannot be guaranteed. Should numbers be reduced within this period of time, the number confirmed two weeks prior to the event date will still be charged for.

 


Final Payment

Full balance payment is to be made 7 days prior to the date of the golf day. Upon receipt of the balance we assume final numbers. Any decrease after this will result in full monies being held Invoices can only be raised for large parties with prior confirmation form Branston Golf and Country Club. A credit agreement form must be completed and approved by Branston Golf & Country Club a minimum of 60 days prior to the event date.

 


Promotional Material

Promotional material can be used in specified areas of the golf complex. Notification and approval must be sought a minimum of 14 days prior to the event date. The club reserves the right to remove any material it feels unsuitable.

 


Dress Code

Soft spikes only no trainers, shirts must be worn tucked into trousers, no denim, shirts must have a collar or polo neck, shorts must be tailored and no more than 3 inches above the knee and worn with sports socks, trousers must not be tucked into socks.


Lightening

In the case of lightning play will be suspended. This will be indicated by a blast of the klaxon. All play must stop, mark your ball as play will not resume until the all clear is sounded.


Slow play

This is major complaint on all golf courses, please prepare your party so that they all tee off at the correct times and courtesy of others is adhered to at all times. Branston Golf Club reserves the right to remove any player if it seemed that they are causing unnecessary hold up in play.  Requests from course marshals are to be adhered to.

 


Tee Times

It is the responsibility of the organisers to ensure that all players adhere to their tee times, and arrive 10 minutes before their allocated tee time. This is essential to ensure play on the golf course runs smoothly.


Half Way House

It is the responsibility of the individuals to obtain refreshments and proceed to the 10th Tee without undue delay.

 

 



WEDDING TERMS AND CONDITIONS

 


Bookings and Deposits

Provisional bookings will be held for 14 days.  On receipt of a completed booking form and a £500.00 (non-refundable) deposit, a booking confirmation will be sent.  The Club reserves the right to release provisional bookings if a deposit has not been received within the 14 days stated. A further non-refundable deposit of £2000.00 is required 12 weeks before the function date. Failure to pay the second deposit will lead to automatic cancellation of the date

Cancellations

In the unfortunate event of cancellation, the deposit is forfeited, and charges will be calculated on the contracted number of adults that has been stated on the booking confirmation form.

The Club will endeavour to re-let any cancelled bookings.  If successful this will reflect in the charges. All cancellations must be confirmed in writing by both parties

 


Final Numbers

Final numbers must be notified at least 14 working days prior to the wedding, this will be the minimum number for which you will be charged, regardless of any last minute alterations.  Should these numbers be significantly less than those indicated when booking, the club reserves the right to charge a cancellation fee.

 


Payment Terms

A Quotation will be submitted and must be paid in full 7 days prior to the wedding by either cash, credit card or bankers cheque.  Personal cheques will only be accepted 14 days prior to the wedding. Any further charges incurred on the day must be paid for before departure.

Tariffs are reviewed yearly.  Any event booked in advance for a forthcoming year should take into account the likelihood of potential increases in charges.  These will, however, be indicated as accurately as possible at the time of booking.


Insurance

The Club does not accept any liability for loss or damage to property owned by or in custody of the client/member/and or guests while the property is on the premises.

 


Liability

The Club accepts no responsibility for the death, bodily injury or disease arising from any cause whatsoever to persons visiting the premises, except for legal liability arising due to negligence of the owners, its servants, employees or representatives.

The member/client hereby undertakes to indemnify the Club for any damage to the premises (or contents) whether or not owned by the club caused by the activities of any person attending the function.  The client/member shall ensure that the client/member's guests observe the high standard of behaviour and the Club reserves the right to expel any guests behaving in a manner which it regards as detrimental to the standing of the Club or likely to cause inconvenience or annoyance to other members.  In the event of the club expelling a guest it shall not be obliged to pay compensation to the guest, member or client.

The Club also reserves the right to accept bookings at their own discretion.




CONFERENCE & FUNCTIONS TERMS & CONDITIONS


Do I need to pay a deposit?

Once you have made a provisional booking, we will issue you with a booking sheet outlining the itinerary for your event.  Your booking will be held for 7 days from the date of the provisional booking.  On receipt of a signed booking sheet and a non-refundable deposit your booking will be confirmed.


Can I change my guest or delegate numbers?

Yes certainly.  However if the numbers are significantly reduced the cancellation charges below will be applied.  If you give us over 7 days notice of a change of numbers, you are able to reduce by up to 20% without incurring a charge.

 

If you provide less than 7 days notice, the contracted numbers will be charged.  If numbers are reduced, The Pavilion at Branston reserves the right to move your event into a room more suitable to your event.

 


When do I have to pay the final balance?

After your initial deposit payment, the full payment of the balance will be due 7 days before your event date.  The amount charged will be based upon your confirmed numbers.  Once the full balance is received we are unable to refund any amount of this payment.


What if I have things I need to bring to The Pavilion before the event?

Should you wish to bring any of your own equipment into The Pavilion, you must ensure that it has been tested and is safe to use.  The Pavilion at Branston will not accept any liability for the equipment you bring and would ask you comply with the rules set out in the Health & Safety at Work Act.  For any third party contractors visiting the venue (i.e. contractors) under your instruction, you must ensure current adequate "Public Liability Insurance" is in place.  Copies of electrical testing certificates and insurance policies must be made available upon request.  Should you have any queries about this our Sales Co-ordinators will be more than happy to help.


Is there anything else I should know?

  • For certain events the Club may charge a deposit of £500 against the cost of possible damage to The Pavilion or its Property, which could occur during the course of the event. Should any damage occur to the venue during your event, then this deposit will be retained on account of the cost of such damage.
  • If you require us to recommend a supplier for anything, the bill must be settled by you directly, not The Pavilion at Branston.
  • It is your responsibility to ensure the supplier fully complies with all regulations as outlined above.


General

The Pavilion at Branston shall not be liable for any loss or damage to property owned by, or in custody of the Client or his agents, employees or guests.  Cars are parked in the car park at the risk of the owners and their guests.


Cancellations

Should you need to cancel your event, we have a cancellation charge in place in order to recuperate any costs incurred to The Pavilion.  These costs are dependant upon how close to the event you decide to cancel, as so the charges are as follows:

Could my booking be cancelled at The Pavilion at Branston?

  • Any part of the venue is closed or unavailable due to events beyond our control
  • The booking, or anyone associated with the booking might damage the reputation of The Pavilion at Branston
